What Is The H-1B Visa?

The H-1B visa allows American employers to hire immigrant workers for specialty jobs that require a bachelor’s degree or a foreign equivalent. These visas are used for jobs in IT, engineering, architecture, finance, and more.

H-1B Visa Eligibility Requirements

In order to be eligible for an H-1B visa, foreign workers must possess:

  • A job offer from an American employer for a role requiring specialized knowledge.
  • Proof of a bachelor’s degree or foreign equivalent in the field they are being hired for.
  • Proof from the American employer showing a lack of qualified American applicants for the role.

Who Is Responsible For Paying H-1B Visa Fees?

Typically, the American employer pays for all related fees for the H-1B visa.

H-1B Employer Costs

Here are some common costs employers should anticipate to pay for when applying for an H-1B visa:

  • Registration Fee: $10
  • Basic Visa Filing Fee (I-129): $460
  • Public Law 114-113 Fee: $4,000
  • Premium Process (Optional): $2,500
  • USCIS Anti-Fraud Fee: $500
  • ACWIA Education & Training Fee: $750 for employers with fewer than 25 employees, $1,500 for employers with more than 25 employees.

H-1B Employee Cost

As we mentioned, most H-1B visa costs are covered by the employer. But, if the employee wants their visa to undergo “premium processing,” they may be responsible for that fee. Generally, employees are also responsible for paying fees related to getting their visa from their local embassy or consulate.

H-1B Premium Processing Fee

The H-1B Premium Processing Fee is optional. Paying this fee will fast-track your decision, cutting the time down to receive a decision on your visa application to about 15 days from when your completed I-907 form is submitted.

How To Apply For The H-1B

Here’s how you can start the process of applying for an H-1B visa and what to expect throughout:

Employer submits a temporary labor certification to DOL

Your American employer will submit the temporary labor certification, or LCA, online. This document goes to the Department of Labor (DOL), so they can see all pertinent details about the job, including letting them know your wage will be similar to what other US employees in positions similar to yours are getting paid.

Employer submits Form I-129 to USCIS

Once the Department of Labor approves the LCA, the employer will move on to Form I-129 and all applicable fees. This part of the application requires documentation showing your professional background, resume, and education details. It’s also apt to include any evidence of training in your specialized field. Your employer should also send a letter of support and your employment agreement with this packet.

You apply for the visa

Now it’s time to take the approval and ask the US Embassy or Consulate for an interview date. On the day of your interview, bring all documentation and fee receipts.

What Happens If My H-1B Application Was Denied?

If, for any reason, your H-1B visa is denied, you’ll have to stop working for your American employer ASAP as you no longer have the status to be legally employed in the US. The good news is that you can appeal the denial — although this process can take up to six months. You can also refile your H-1B vis application, with all errors or omissions from the denied application fixed.
